Code Enforcement FAQ

Here are some Frequently asked questions from our Code Enforcement Officer.

Do I need a permit to erect a fence?

Yes, any fence under 6ft in height requires a zoning permit and a fence permit. Any fence that goes over 6ft in height at any point requires a zoning permit and full building permit.

Do I need a permit to erect a retaining wall?

Yes, any retaining wall under 4ft in height requires a zoning permit and a wall permit. Any wall that goes over 4ft in height at any point requires a zoning permit and full building permit.

Do I need a permit to install a new roof?

Yes, installing a roof on a residential property requires a Maintenance/Improvement Permit. Installing a roof on a commercial property requires a full building permit.

What constitutes a junk vehicle?

A junk vehicle is any vehicle that is not currently registered, inspected, licensed & operable.
  – Junk vehicles cannot be stored or kept in public view on private property, being kept in garage is ok.
  – Code Enforcement can ONLY cite junk vehicle(s) kept on private property, NOT ones parked on the street. Ones on the street are handle by the Police Department.

Does the city own my sidewalk?

No, sidewalks along with their maintenance, cleaning & repairs are the duty of the adjacent property owner.
  – You own your sidewalk and must keep it clear of all tripping hazards “cracks/damage, snow, ice, vegetation”.

Can I cut a neighbors tree limbs that encroach on my property?

Yes, you can trim/cut any vegetation “tree, bush, hedge, vine” that
encroaches onto your property up to the property line.
  – The only time a tree MUST be removed is if the tree is dead and poses
a safety hazard.

What happens when I report a property?

The Code Enforcement Officer will go out to verify that there is in fact an ordinance violation.
The property owner is given a certain amount of time, depending on the type of violation to abate the issue.
If, after the deadline the issue has not been resolved, a citation will be issued and it will be handled by the magistrate.
